THE SHORT STORY:
Volkswagen and Audi owners have purchased TDIs with a Bosch high pressure fuel pump. Often they purchased an extended warranty, and they were led to believe the warranty covered repairs to the high pressure fuel pump. In many instances, the fuel system failed because of the high pressure fuel pump. Some Volkswagen or Audi dealerships have refused to repair or replace the high pressure fuel pump or the fuel system. Volkswagen or Audi may also deny that the high pressure fuel pump is covered under a warranty, partially pay under the warranty, or agree to some other limited amount of coverage. In some cases, Volkswagen has claimed that the problem is not with the high pressure fuel pump, and instead has accused owners of using non-diesel fuel or poor owner maintenance.
THE LAWSUIT'S CLAIMS:
Volkswagen and Bosch defectively designed, manufactured, marketed, and sold the high pressure fuel pump, which is intended to reach consumers like you.
Volkswagen and Bosch’s design, manufacture, and marketing of the high pressure fuel pump was fraudulent.
Volkswagen and Bosch’s design, manufacture, and marketing of the high pressure fuel pump was a violation of deceptive trade practices laws.
Volkswagen and Bosch breached warranties in the design, manufacture, and sale of the high pressure fuel pump.
Among other relief, the lawsuit asks the court to award Volkswagen TDI and Bosch high pressure fuel pump owners:
Money damages to reimburse Volkswagen TDI owners.
Triple damages based in part on the out-of-pocket expenses Volkswagen and Bosch’s have caused Volkswagen TDI owners to incur.
Exemplary damages.
Attorneys’ fees.
The lawsuit asks the court to:
Order Volkswagen and Bosch to stop misrepresenting the cause of the malfunction of the high pressure fuel pump.
Order Volkswagen and Bosch to take all steps to fully investigate the source of the problem with the high pressure fuel pump.
Provide alternative transportation to Volkswagen TDI owners at no cost to them while Volkswagen and Bosch repair or replace the defective high pressure fuel pump.
Stop collecting financing or lease payments from TDI owners whose vehicles were financed or leased from companies owned or within the control of Volkswagen and Bosch.
Order Volkswagen and Bosch to make payments on behalf of Volkswagen TDI owners who have leased or financed their vehicles using other financing companies.
NO COURT OR JURY HAS RULED ON ANY OF THE CLAIMS MADE IN THIS CASE AND THERE HAVE BEEN NO SETTLEMENTS. VOLKSWAGEN AND BOSCH DENY THE CLAIMS IN THE CLASS ACTION LAWSUIT.
